Whom these terms apply to

Welcome to Weytr, and thank you for reading and getting to know our Terms of Service (shortened to “the Terms”). The purpose of this document is to inform you of the legal responsibilities and rights that you accept when you use any of our Services. These terms are in effect for all existing and future users of Weytr without limitation, and any person that the Customer is making order for or on behalf of. It is also in effect for Venues, and any other person or entity with access to the Weytr administrative system.

2. Eligibility to use Weytr’s services

 

Acceptance of Terms

When you use any of our Services, you acknowledge that you have understood, agreed and accepted all the Terms in this document, and that you are fully competent and able to comply with the Terms.

 

Age limit

Users below the age of 18 (eighteen) are not eligible to use any of Weytr’s services. You hereby warrant that you are at least 18 years of age.

 

Laws and regulations

You are in compliance with all the laws and regulations in the country in which you use the Services, independent on what is your regular country of residence. You are also in compliance with the laws and regulations of your country of residence, independent on where you use the Services. You agree to use the Services only in compliances with the applicable laws and regulation and the Terms. You also agree not to use them in a manner that violates our legal rights, or those of our Partner’s or any third-party.

United Arab of Emirates is our country of domicile and the governing law is the local law.

 

Amending the terms

You accept that Weytr may amend, update or otherwise change these Terms entirely at it’s own discretion, and that it is the responsibility of the User to check the Terms for update at regular interval. By continuing to use the Services, you are accepting the Terms in effect at the time of the interaction, and you agree to be bound by the Terms and the changes/amendments made to it.

 

Access to your account

You acknowledge and agree that Weytr reserves the right to disable access to your account, and that this may prevent you from accessing any part of the Services or Content connected to it. We may do so at our own discretion.

 

Use of data

You acknowledge and agree that by using the Services, you are fully responsible for the amount of data transmitted to and from your device(s). Weytr cannot be held liable for any cost, damage or consequence related to the amount of data used by Weytr’s Services, whether it’s due to the normal functioning of the Services or any error. This also applies to updates to any part of the Weytr platform, such as automatic updates in the Play Store or App Store, and to the use of other services such as social media and third-party websites, as a result of using the Services.

 

Limits on the service or your account

You acknowledge and agree that Weytr may at its own discretion set limits on your usage of any part of the Services, such as, but not limited to, the amount you spend, number of purchases, number of logins, number of different IP addresses from which you access the services, sharing of Content.

 

Changing services

You acknowledge and agree that Weytr may change the way the Service behaves at any time entirely at its own discretion. This includes, but is not limited to, changing/adding/removing/suspending features, adding, removing or changing fees associated with the use of the Services, adding/changing/removing Service Content. No notice will be given.

 

Translations

You acknowledge and agree that texts that are made available by Weytr in other languages than English are for informational purposes only, and translations may be incorrect or outdated, and that the English version in all cases shall govern the terms of your relationship with Weytr. In any case of inconsistencies between the English and translated version of any information, including this document, the English version shall prevail over others.

 

Third-party links and referrals

You acknowledge and accept that links displayed any place in the Service to third-party websites, apps or other services, including, but not limited to, referral or incentive based programs, may be governed by their respective terms and conditions, and are not to be considered an endorsement on Weytr’s part. Furthermore, Weytr reserves the right to terminate and/or suspend the User’s account and/or credits/points earned, if there is reason to believe that the user has violated the Terms of Weytr or the third-party, or has engaged in activities that are fraudulent or illegal in nature. These programs may also be modified, cancelled or discontinued without notice to the user.

 

Information available in Weytr’s services

You acknowledge and accept that any information made available to you during the use of the Services, is for informational purposes, and may be incorrect, incomplete and/our outdated. Information related to Venues and the menus and menu items they list in the app, such as, but not limited to, Venue descriptions, menu item descriptions, promotions, names and photos are solely the responsibility of the Venue to keep correct and up to date. Weytr may in no way be held liable for any errors or omissions in this information.

 

You acknowledge and accept that information related to allergens and allergies is provided for informational purposes, and Weytr cannot guarantee its accuracy. You are solely responsible for knowing your allergies, communicating your allergies clearly and making sure it is understood by the Venue. The Venue is responsible for taking every possible precaution to adhere to that request, and to clearly communicate any difficulties in doing that.

 

Ordering items in the app

By using our Services, you understand, accept and agree that:

  • Some menu items are suitable only for certain ages. We encourage you to both check all information available in the App, and ask the staff if something is unclear. Information contained within the app may be inaccurate, not up-to-date or missing.
  • Delivery times are approximations and for informational purposes. They may vary depending on many factors and are not to be considered a guaranteed delivery time.
  • All photos shown in the Services are to be considered illustrations, and may not accurately represent the actual product
  • Please note that when an order is placed in the App, it is not eligible for cancellation.
  • Visa and Master Card in AED will be accepted for payment
  • A payment confirmation will be sent to your registered email within 24 hours of purchasing
  • We will not trade with or provide any services to OFAC and sanctioned countries
  • Customer who are minor/under the age of 18 shall not register as a User of the Services and shall not in any way use the Services or perform any transactions in relations to the Services
  • Cardholder must retain a copy of all transaction records, as well as a copy of these Terms and Conditions and our Privacy Policy

 

Settings and filters available in Weytr’s services

You acknowledge and accept that any settings or filters in the App, such as, but not limited to, filtering menu items (including for allergens or item type), is purely for convenience, and may be be incorrect, incomplete and/our outdated. It’s your responsibility to ensure that the items ordered through the use of our Services are in compliance with your requirements.

 

Currency and conversion

You acknowledge and accept that currency conversion in Weytr is provided for informational purposes only, and is not to be considered accurate or up to date. The final transaction will be made in the local currency (AED), regardless of which currency you choose to convert to, and the final sum may differ from the calculated estimate by a small or large degree.

Complaints

You acknowledge and accept that any complaints related to Venue Services are solely the responsibility of the Venue. Weytr may in no way be held liable for perceived or real breaches of a standard of customer service, hygiene and/or general standard, mistakes made by the Venue, inconveniences such as, but not limited to, loud noise/music, linguistic challenges, temperature, weather conditions, other guests and full premises. You agree and accept that any complaint related to Venue Services shall be directed at the Venue, and that Weytr has no jurisdiction over how the Venue responds to any complaint.

Refunds

You acknowledge and accept that refunds are subject to a case-by-case assessment first by the venue where the order was placed, and then, if an agreement can’t be met, by Weytr. All refunds of payments made in Weytr will be processed in the same manner as they were received. Please allow for up to 45 days for the refund transfer to be completed.

Mistakes made by the User

You acknowledge and accept that any mistake made by the user while using the Services are solely the responsibility of the User. Weytr cannot be held liable for any costs, damages, delays or consequences directly or indirectly caused by such mistakes. This includes, but is not limited to, ordering the wrong item, inserting the wrong Weytr code, registering your order at the wrong venue, paying with the wrong card, moving from the position in which you registered your order.

User account

You acknowledge and accept that in order to be able to use Weytr’s Services, you must create an account. You alse accept that any data or information provided to us by you or third-party services, such as, but not limited to, social media logins analytics tools and payment processors are governed by our Privacy Policy.

 

You accept that it’s the sole responsibility of the User to keep the password confidential. Sharing your login credentials to any third-party is prohibited, and you will be liable for any such breaches of the Terms.

Unauthorized access to the User’s account

You acknowledge and accept that you are responsible for all activities that occur in your account. This responsibility includes notifying Weytr immediately if you are suspicious or have confirmed any unauthorized access to your account, and immediately taking the necessary steps to protect the integrity of the account, such as changing password.

 

You also agree and accept that allowing any third-party access to the account and Services for any purpose is prohibited, and you will be liable for any such unauthorized access.

Account license

You Weytr accounts is personal, non-transferable and may only be used for personal and non-commercial use.

Fraudulent or disrupting activity

You acknowledge and accept that you will not engage in any activity that might be considered illegal, unlawful or fraudulent, that breaches any of the Terms, or that disrupts the Services in any way. You also understand and accept that you shall not engage in any activity that causes inconvenience for other Users, Venues or third-parties, such as spamming, trying to or succeeding in gaining unauthorized access to a User or Venue account, trying to or succeeding in gaining unauthorized access to any part of the Weytr platform.

Privacy policy

You warrant that you have read, understood and agreed to Weytr’s Privacy Policy.

 

2. Content

 

Content accuracy and third party rights

You acknowledge and accept that you are responsible for ensuring that all information you provide, type, upload or otherwise makes available to Weytr during the use of our Services, is correct, complete and up to date to the best of your knowledge, and that it does not violate any third party rights. It is your responsibility to immediately amend or remove the information if it is no longer up to date.

 

For Venues, this includes, but is not limited to, venue name, description, phone number, email address, opening hours, bank account number, item names, item descriptions, item price, menu names, allergen information, item categorization and all images.

 

For Users, this includes, but is not limited to, your email, name, reviews, customer support inquiries and complaints.

 

Intellectual Property and Confidentiality

Amlie Solutions is the sole and exclusive owner of all Intellectual Property associated with Weytr and its Services throughout the world. You agree that all information provided to you by us through the use of our Services or through communication with us, is designated as confidential by Amlie Solutions, and may not be disclosed to any third party in any way or at any time without a written consent from us. You agree and accept that you have no right to use any of Amlie Solution’s logos, trade names, trademarks, brand features or other intellectual property without a prior written consent from us. You also agree not to display any of our intellectual property in a way that was not intended by us, such as building it into a frame on your website, displaying it in your own app, in any way try to pass on our Services as your own, or exploiting/commercializing our Services.

 

You agree to notify us immediately if you become aware that any part of our Services infringe the rights of any third party.

 

You accept and understand that you cannot copy, reproduce, incorporate into your own work or in any way exploit the Intellectual Property associated with Weytr.

 

Any violation by you the Terms in this document may result in the immediate termination of your right to use the Services, as well as potential liability for infringement of Intellectual Property Rights.

Submitting content

You are responsible for all your Content. You may not submit content through any automated means such as a bot. You will be held liable for any breach of Weytr’s rights, that of any third party or local and international laws and regulations. Your Content may not be copied or reproduced in whole or in part from any other content available online or offline.

 

You agree and accept not to post any content in any form that:

  • Violate our Terms and Conditons
  • Is defamatory, threatening, indecent, harassing, abusive, obscene, hateful, racist or libelous
  • Invades on the privacy of another person or legal entity
  • Attempts to impersonate another person or legal entity, or give the impression that the content is submitted, endorsed or sponsored by a third party
  • Attempts to give the impression that the content is submitted, endorsed or sponsored by Us
  • Is in any way influenced by any conflict of interest
  • Breaks any applicable laws or regulations
  • Shares information that breaches another entities Terms and Condition
  • Attempts to disrupt Weytr’s services in any way, such as hacking or harming the integrity of the Platform
  • Attempts to distribute malicious software such as a virus,or malware
  • Attempts to reverse-engineers, decompile or in any other way gain access to Weytr’s source code
  • Scrapes or catalogues any content connected to Weytr’s services
  • Attempts to sell, lease or in any other way commercialize Content found in Weytr’s Services
  • Spreads misinformation or in any way misleads Weytr, Partners or any person
  • Threatens the security, integrity or sovereignty of UAE or any other country
  • Insults or offends any nation, governmental entity or person
  • Attempts to prevent or manipulate investigation of any offence
  • Links to any third party website or app that violated these terms or is unrelated to the Content
  • Shows images of, reveals the identity of or discusses minors in any way

 

Any Content uploaded, written or made available by You may be subject to investigation under applicable laws in UAE, the country of use or your country of residence. Weytr reserves the right to delete, change or block access to any Content without notice.

Reviews

You warrant that any review that you submit are your own words, and truthfully and accurately describe your experience as it happened. You were not paid or remunerated in any way in connection with your review, and you have no competitive, financial or personal incentive to author a review that is not a complete and honest description of your opinion. Upon setting a score for any part of our Services, such as a score for a Venue you have visited, you warrant that the score is fair and unbiased by any competitive, financial or personal incentive.

 

You will not use any defamatory, offensive or hateful language, and will not make anyone personally identifiable through your Content.

 

You accept that reviews are the opinion of the User that submitted it, that it does not reflect the opinion of Weytr, and that it is not endorsed by Weytr. Weytr is a neutral platform that allows communication between Venues, Users and the public in a free manner, as long as it is in accordance with the Terms and applicable laws.

 

Removing content

Weytr reserves the right to remove any Content at any time for any reason without prior notice. We may also block access to the content for you, or any other User or visitor.

 

Submitting ideas, giving Us Feedback and suggesting Venues

You understand and accept that any idea for new features, improvements or content, feedback on existing features, content, staff behavior, design, code or language made available to Weytr can be used by Weytr without limit or any restrictions, without compensation or credit to the User in any form. You also agree that any such feedback given may already have been suggested by someone else, or by Weytr, and may be under consideration or development.

When you submit Feedback, Ideas and suggest Venues, you agree that you have granted Us a global unrestricted license to develop, use, publish, sublicense, share, commercialize and modify the Feedback. You irrevocably waive any claims/assertions of any nature against Weytr, its staff, Partners and subsidiaries.

 

You agree that your Feedback does not include any confidential information of third parties. Weytr is not obligated to keep Feedback you submit confidential.

 

Advertising

Some parts of the Services may have visible advertising and promotions for third parties. These advertisements may be personalized by accessing information stored in your Weytr account or connected third party services. You accept that the information connected to your account and use of the Services may be made available to such advertising services, and that we may place such advertising in parts of the Services. You also accept that Weytr is not in control of what the advertising algorithms may display, and we may not be held liable for its content. Advertising messages are not to be considered an endorsement or recommendation from Weytr.

 

Limitations of Liability

To the fullest extent permitted by applicable law, Weytr, its subsidiaries and staff shall in no event be held liable to you for any damages, personal injury, property damage, financial loss or consequence of any nature resulting from your access to and use of the Services, inaccuracies of content, unauthorized access to any information stored in Weytr’s servers and/or offices, any interruption or errors transmitting data to and from our servers, any bugs, trojan horses, malware, viruses or the like transmitted from or through the Services by a third party or unknowingly by Weytr, any loss of personal data or Content from our servers, any loss, damage or consequence as a result of You submitting or otherwise making available Content to our servers, the actions of any third party, Venue or User as a result of having access to or using the Services, your failure to keep password or account details secure and confidential, loss or damage as a result of reliance placed by you on the accuracy of any advertising for Weytr or third parties or any relationship or transaction between you and any advertiser who’s advertising appears on the Services, however caused and under any theory of liability, including, but not limited to, any profit loss, loss of reputation or goodwill, loss of data, loss of privacy, cost of procurement of substitute goods or services or other intangible loss. Unless otherwise agreed to in writing by Weytr, the total liability of Weytr to you for any cause of action you take against Weytr will at all times be limited to 500.00 (five hundred) AED.
